Introduction
This Acceptable Use Policy (AUP) governs the use of all products and services provided by Beetexting (Technocentra Group, Inc., d/b/a Beetexting, referred to as "Beetexting", "we", "us", or "our"). This policy applies to all customers and end users (collectively referred to as "you" or "your") of Beetexting's services, including any messaging channels or types available through our platforms or through your own platforms using our technology.
Acceptable Use and Prohibited Conduct
General Use
You are expected to use our services responsibly and in compliance with all applicable laws, regulations, and this AUP. Our services must not be used to transmit or store content or communications that are illegal, harmful, unwanted, inappropriate, or objectionable. Specific types of prohibited content include, but are not limited to:
- False or inaccurate information (including information related to the origin of the message or the “reply” routing information)
- Content promoting hatred or violence or promoting a hate group
- Content that endangers public safety
- Illegal, harmful or fraudulent activities, or content that promotes such activities
- Infringing on or violating another party’s rights, including intellectual property rights or privacy rights
- Intentionally evading content filters or snowshoeing
- Phishing or pharming or use or shared public URL shorteners
- Harassing, defamatory, or obscene materials
Consent and Communication Compliance
Obtaining Consent: Before sending any messages, you must obtain explicit consent ("opt-in") from recipients. The consent must be timely and appropriate to the message type that you send them (e.g., marketing or transactional), the channel that you use to send the message (e.g., SMS), and the origin of the message (e.g., if a consumer consents to receive messages from a particular brand, it is not a blanket agreement to receive messages from other brands or companies that you own). If a consumer initiates contact with you, you may respond to their question or request via the same channel, but only within the context of that conversation. You may not send additional, extraneous, or marketing messages. You must maintain consent records in an auditable manner so that they are available for verification. You may not use an opt-in list that has been rented, sold, or shared to send messages. You must create and vet your own opt-in list.
Revocation of Consent: Recipients must be able to easily opt-out of receiving messages at any time. The initial message must include standard opt-out instructions, such as "Reply STOP to unsubscribe,” and must honor all typical opt-out keywords (such as STOP, UNSUBSCRIBE, or QUIT).
No Sale or Sharing: You will not sell, share or otherwise transfer to third parties or affiliates mobile or opt-in consent information for marketing or promotional purposes. You may share information with your service providers if needed, subject to appropriate contractual limitations.
Prohibited Activities
The following list is not exhaustive. It provides examples of the types and categories of activities that are prohibited.
- Interference with Services: Do not interfere with, disrupt, or negatively impact any aspect of our services or reputation or that of any related third-party networks.
- Violations of Laws, Regulations or Standards. Do not violate industry standards, laws, regulations or other governmental orders or telecom providers’ requirements including, for instance, those relating to consent, recording, data use or retention, monitoring of communications and opt-out requests.
- Unauthorized Access: Do not attempt to gain unauthorized access to our services. This includes, without limitation, efforts to bypass, exploit or disable any limitations or restrictions placed on our services, or finding or exploiting security vulnerabilities.
- Harmful Code: Do not transmit harmful code or use automated systems like bots to manipulate or attempt to disable our services, such as through a denial of service (DoS) attack or the introduction of viruses or any other type of malware.
- Reverse Engineering: Do not, and do not attempt to, reverse engineer, copy, disassemble or decompile our services or technology.
Customer Acknowledgements
Customer acknowledges and agrees that:
- THE SERVICES AND ORDERED SERVICES ARE DESIGNED AND INTENDED FOR REGULAR BUSINESS USE, AND ARE NOT DESIGNED, INTENDED, OR RECOMMENDED FOR USE IN ANY SITUATION WHERE SERVICE DISRUPTION, INTERRUPTION, UNAVAILABILITY, FAILURE, ERROR, ERRONEOUS OR UNDELIVERED OR INTERCEPTED MESSAGES OR COMMUNICATIONS, ETC. COULD RESULT IN DAMAGES OR PERSONAL INJURY OR DEATH TO/OF ANY PERSON OR ANY OTHER CATASTROPHIC OR SIGNIFICANTLY HARMFUL OUTCOME (“HIGH-RISK USE”), WHICH HIGH-RISK USE IS EXPRESSLY PROHIBITED BY THIS BEETEXTING ACCEPTABLE USE POLICY;
- Services and/or Ordered Services may not be available in the event of a loss of power or internet connectivity, or network congestion; and
- Customer is and shall be and remain responsible for all accessing and/or use of Ordered Services (and/or any other Services or elements of Beetexting Infrastructure accessed and/or used by any Customer Party) (collectively, “Covered Access/Use”), as well as for ensuring that all such Covered Access/Use complies with this Beetexting Acceptable Use Policy, regardless of whether such Covered Access/Use is or is not performed, directed, permitted, or sanctioned by Customer or any Customer Party; accordingly, CUSTOMER SHALL BE RESPONSIBLE AND LIABLE FOR ANY AND ALL ACTS OR OMISSIONS BY OR ON BEHALF OF ANY CUSTOMER PARTY AND/OR ANY COVERED ACCESS/USE IN VIOLATION OR CONTRAVENTION OF THIS BEETEXTING ACCEPTABLE USE POLICY (ANY OF WHICH SHALL CONSTITUTE AND BE TREATED AS A MATERIAL BREACH OF THE AGREEMENT BY CUSTOMER).
Monitoring and Enforcement
Beetexting reserves the right (but does not assume the obligation) to monitor the use of its services to ensure compliance with this AUP. We may take any necessary action to protect our services, including removing content, suspending or terminating your service, and reporting violations to law enforcement.
Data Safeguards & Country-Specific Requirements
You are responsible for determining whether our services offer appropriate safeguards for your use of those services, and that any data you transmit or process through our services complies with all applicable laws, regulations, and industry standards. Additional requirements may be imposed if you are using our services in countries other than the United States. You are responsible for ensuring that your use of our services complies with those countries’ requirements related, for instance, to your use of our services, processing personal data in connection with your use of our services, and the products or services that you use our services to offer in those countries.
Modifications to this AUP
Beetexting may modify this AUP at any time. Changes will be effective immediately upon posting the revised version on our website. By continuing to use our services, you agree to the revised AUP.
Reporting Violations
If you become aware of any violation of this AUP, you are required to immediately notify us and cooperate with us to remedy the violation.
Definitions
Capitalized terms used in this Beetexting Acceptable Use Policy used and not defined in this Beetexting Acceptable Use Policy shall have the meanings assigned to them in the terms of service, agreement, or other document or content incorporating this Beetexting Acceptable Use Policy (the “Agreement”)
Conclusion
This AUP is part of your agreement with Beetexting when using our services. It should be read in conjunction with our terms of service, into which it is hereby incorporated by reference. By using our services and technology, you agree to comply with this AUP and ensure that your end users do the same. Failure to comply with this AUP may result in suspension or termination of your services and legal action if appropriate.
